my husband wants to adopt my son

What is the name of your state (only U.S. law)? Wisconsin

My husband wants to adopt my son. The biological father is not listed on the birth certificate. Paternity has never been established and no orders for child support have been made. The last time I saw him I was 4 months pregnant. My son is now 5 and my husband wants to adopt him. I have no idea where his biological father might be. Last time I saw him was in Wisconsin and he let me know he wanted nothing to do with his child. I shortly after moved to Illinois until my son was born and then to Tennessee by my family. I recently moved back to Wisconsin and since have gotten married. I'm slightly worried that if by some miracle we could find him (back in the day he was often in jail and living day to day with different friends couches) and we're required to get him to sign he may refuse just to be difficult (typical of him). Is there a way I can get his rights terminated without having to track him down? If I can prove abandonment maybe?

Consult a local ADOPTION attorney. The laws very a bit from state to state. However, its possible that his rights could be involuntarily terminated due to abandonment.

I don't think the abandonment clock can even start running until paternity has been established.

Every state is different, which is why I said to consult a local adoption attorney. What you stated would not be true in several states that I am familiar with.

Actually it can in many states. It starts running from the moment the putative father is aware that he may be the father of a child and said child is born.
