my privacy rights/ drug dogs in my house

I have had major roommate issues for awhile. She has moved out and now owes back rent and rent until the end of the lease. While I didn't smoke pot while she was living here, she knew that I smoked, and is now using that as her reason for moving out, which isn't true. She and her dad (the cosigner) now want to get drug dogs into my apartment to prove that I had drugs in there. What are my rights?? can they just search my apartment? if I clean up my stuff and deny it, what will that do? Can she use this as a legit way to get out of paying rent, when her name is still on the lease, and i have paid all of my rent on time?

Since any occupant of a dwelling can be cited for possession of an illegal substance. Whether or not you smoked while she was there is not the issue, it still could have adversley affected her both legally, if the drugs were discovered in the apartment or if there was an agreement not to smoke, it doesn't matter whether or not she was there when it happened. Your contract for the lease doesn't include illegal activities or smoking if there is a non smoking clause. You broke the contract.

Unless your lease has some type of clause for a roommate smoking pot, doubt it, the rent and drugs are two separate issues. Further, if this guy thinks it's going to take dogs to find some minuet iota of weed and conveys that to the police, I doubt they will be sticking their necks out to get a search warrant on some feuding roommate’s testimony. If you’re smoking in there, quit and get that junk outta there. Meantime, continue to pursue the rent issue, so you’re not getting screwed out of money.

sue her and dad in small claims court. the judge will disregard any testimony about pot smoking unless she has actual proof you were smoking while she lived there with you.
