If you think you have a sound case against her, then it's money well spent. On the other hand the $3000 may be just the tip of the iceberg. If he is found or comes forward and has reason for not seeing child the court may still allow him some sort of visitation. It may be good to let a sleeping dog lie...what does your attorney advise?

Laws are different state to state but here's a situation I am familar with....
A friend in Kansas had the same thing happen, but it was the mom out of the picture. Couldn't contact her for anything but when it came time for court she showed up from nowhere....he did win custody of both his children. She only gets visitation if the kids pursue it and was ordered to pay support. To date she hasn't paid any support in over 2 years! To top it off, the daughter wanted to visit Mom to get to know her, she went and the mother hasn't returned her. They've called, went to her home to get the girl, etc no one answers phone or door. My friend contacted the sheriff who told him he'd have to go back to court and get a new order since possession is 9/10 of the law even regarding our kids. So it makes you wonder why you get a Court Order anyway since there are so many loop holes in the laws.

First you should read the North Carolina General Statutes 7A-289.20-289.32 which deals with termination of parental rights. Just because he has not seen his daughter in 2 years is not grounds for TPR.

Those are repealed session laws now.

http://www.ncga.state.nc.us/Statutes/GeneralStatutes/HTML/BySection/Chapter_7B/GS_7B-1111.html

(4) One parent has been awarded custody of the juvenile
by judicial decree or has custody by agreement of
the parents, and the other parent whose parental
rights are sought to be terminated has for a period
of one year or more next preceding the filing of
the petition or motion willfully failed without
justification to pay for the care, support, and
education of the juvenile, as required by said
decree or custody agreement.

(7) The parent has willfully abandoned the juvenile for
at least six consecutive months immediately
preceding the filing of the petition or motion, or
the parent has voluntarily abandoned an infant
pursuant to G.S. 7B-500 for at least 60 consecutive
days immediately preceding the filing of the
petition or motion.

There are other listings up there as well.

Shop around for another attorney. Also, you can put a notice in the paper in the county of his last address.

Might Save A Little

While I Have No Experience In This Area, I Have Spent The Day Researching Nc Laws. From What I Read It Appeared To Me That It Is One Year With No Contact And/or No Support. It Also Looks Like There Are At Least Six Different Categories And That The Courts Only Have To Have Evidence Of One Infraction. Obviously, The More The Better. I Also Read That You Can Print Many Of The Forms And Complete Them On Your Own. It Might Be Worth Your While To Research That And Handle As Much Of The Leg Work On Your Own, Then Get A Price From Another Lawyer. Good Luck!

Why are you capitalizing every word? It makes your posts more difficult to read.
