YOUR STATE NAME - illinois -- 2 years ago a judgement was handed down on us of: 1) a reinstated arrears of over 6,000.00, with interest added. 2) alimoney to be paid for the past 13 years even though she lived with another man during that whole time and admitted to that on the stand. we had the proof that we did not owe that arrears from 10 years ago but the court would not take the time to recalculate the amount. so he is making us pay it all over again now with interest. so this weekend we get a letter from the division of child support enforcement saying that yes we did over pay them and that we are entitled to a refund . so a few days later we received a check in the mail from u.s. department of treasury in the amount of almost 1,000.00. so now im not sure what to do . 1)-do we sue her for lying on the stand about not receiving c/s and making us pay it all over again, sue her for deflimation of character b/c ppl were saying "hey, heard you r being sued for not paying your c/s, sue her for mental stress b/c during the process of this whole court battle i had to rush my spouse into the emergency room b/c we thought he was having a heart attack but luckily it wasnt but he did have to go on medication for anxiety and depression, sue her b/c she inflicted an unnecessary financial hardship on us and forced us into bankruptcy due to all the attorney fees and other past debts she was awarded(medical bills for child ,even though we did pay them ). 2) go after her for frauding the court and comitting perjury about an already very touchy issue that is child support. saying she wasnt getting it when she really was! 3). or can the case be reopened on a circuit court level b/c the court errd in not taking the time to review the payment records thoroughly, in which case we can try again to get the alimony thrown out b/c she lied once about receiving the c/s so the judge will likely not grant her that the second time around!we really need some good advice on this matter. this is to big for us to just sit and let go by. we can not afford an appeal in any way(e refinanced our home already the first go around for the attorneys) . that is why im asking if we have any standing on reopening it at circuit level. then if we do hire an attorney we can hold her responsible for those attorney fees if the court rules that way. please help me . i knew i was right all along and i had all the records to prove it , but no one would listen to me !!!!
