I have a question about my rights as a NCP parent. I have asked time and time again the Custodial parent to provide me with our son's daycare information. I'm just asking for the name of the place and telephone number and the mom refuses to give it to me. Doesn't she have to provide me with this information? She told me that since she is the one that drops off the child at daycare and picks him up that I don't even need to know about it. I just would like for emergency purposes. Can she with hold this information from or is this contempt? Thanks!!

I don't think it would actually be contempt unless your order specificaly says she must give you the info.....without being noticable- follow her from her house to the daycare one day- them you'll know

She has sole legal custody.

Our court order reads exactly as-

An order of sole custody to one parent does not deprive the other parent from the following authority:
To inspect and receive school records and to consult with school staff concerning the child's welfare and education;
To inspect and receive governmental agency and law enforcement records concerning the child;
To consult with any person who may provide care or treatment for the child and to inspect and receive the child's medical, dental, and psychological records;
To authorize emergency medical, dental,psychological,psychiatric or other health care for the child if either parent is, for practical purposes, unavailable;
To be the child's conservator, guardian ad litem, or both.


I live 2 hours away so following them to his daycare isn't an option. I just would like to know where he goes. Possibly speak with the daycare provider. I just want to be a part of my son's life and speak with the person he spends the day with is all.

There isn't a section about daycare and whether or not if I can have the information concerning it or not.

Thanks for quoting it exactly -- we go through ugliness here trying to get the exact wording!

Then you have every right to know all about your child's daycare provider. I'd send her a letter, registered/return receipt requested (RRR), and demand the info on the basis of your CO. If she refuses, file contempt.
