What is the name of your state (only U.S. law)? Texas My daughter was dignosed with a bladder infection & sent home from hospital ER. She could hardly walk she was in such pain. The next day she was in servere pain & could not walk or even raise her head. My granddaughter called the ambulance to come get her from home. She was rushed in to surgery by another doctor for emergency surgery with ruptured appendix. He said it was the worse appendix he had ever done. Also there was a tumor he removed! The hopital bill was terrible & they are hassleing her to pay it! She was in the hospital nearly two weeks. A single parent with no income but hers she nearly lost everything she had. Does she have a good case of malpractice.

If you think that there is a malpractice case, you have to have an attorney be ready to believe that there was malpractice, and that the treatment was below the standard of care.
If that happened, you then have to show that the malpractice caused the problem, and that there is a financial cost that the malpractice caused.
A one day difference negates most of the harm that can be shown. 2 symptoms, that can be similar, and takes 24 to confirm, is very difficult to show as malpractice.
Let's be glad that you daughter is recovering, and you should be speaking to the hospital about the costs, because if an emergency room is required to cover the costs of those that are without the funds to pay, there is a lot of room to work with this.
Remember that they can't get blood from stone, so if the financial situation is as you say, they can send the bill but the odds are they are not going to get paid.
