so you can settle for $100k and be done with it.

OR

go to trial and hopefully win more than 100k. the insurance company will pay you the 100k and you can go after the other driver's assets. Depending on how much above 100k you won, the other driver will most likely file for bankruptcy, your judgment will be discharged and you will get nada.
