I was hit in the right rear of my truck. I'm not sure if I should consult an attorney or not. Here's what happened:

I came to a stop sign. It's a 2 way stop (the way I was coming and on the direct other side of the street coming towards me). On the right is a corner property that has very high thick shrubbery. I looked as best I could and though I was clear then proceeded into the intersection. A truck honked and hit me. The speed limit on the road the truck was traveling was 45. My truck spun around and landed on the other side of the road I was heading towards. The police did not issue me any citations, but I'm not sure if the other driver rec'd any. There were no skid marks that indicated he tried to stop from hitting me. I cannot obtain the police report for at least a week.

There are over $3,000 worth of damages to my truck. The damage includes the right rear door & quarter panel, bumper, right rear wheel well, tire and rim, right rear window, alarm system and transmission lines. Inside the car, the seatbelt which held my son's carseat in gave way (unbuckled) and allowed the empty car seat to fly across the car into the back of my seat and head. Thankfully, my children were not in the car. I did not ask for medical treatment at the scene, because I did not think I needed it. Later that evening, my neck and back started to hurt so I went to the ER. They diagnosed a cervical strain/sprain and possible pinched nerve. They asked me to follow up with my family dr. My arms keep going numb on me - but the dr at the ER said that could be a pinched nerve.

I don't want to be one of those people who start frivelous law suits - but my husband thinks I should look into it in case the damages to my car aren't covered fully. Do I have a legal leg to stand on in this situation?

Thanks!

Hire an atty f/ what? You're at fault. It would be a frivelous lawsuit as you wouldn't win. If the truck that hit you didn't have a stop sign then doesn't this tell you something? You failed to yield the right of way and the only reason you didn't get a ticket is NJ is a no-fault state.

Ahhh yes, the famous cervical strain. You got a little whiplash, you'll live. Turn your meds into your own insurance co. as is required of a no-fault state. Next time pay attention to the traffic coming the other way before proceeding at a stop sign. This way you don't get whiplash.
