Going to court this morning, for judgement, finishing up on bankruptcy paperwork. Should I tell the judge I am filing, will they go ahead and try to garnish my check or should I agree to the judgement and then just file.

Thanks for any advise

I wouldn't say a word about bk under these circumstances. You don't want to light a fire under them and they rush to garnish while they can. I'd just file that bk no later than Monday morning and be sure you include that judgment.
Then, I think I'd serve a copy of the bk petition {with the filing number} on the plantiff and their attorney just to be on the safe side.

Thanks for the advice the lawyer for the other side didnt show up so the judge just continued the case, and I will be filed way before I go back.

I am sorry to ask this question - but I thought if there is a no-show on the other side, the case is automatically dismissed..... Am I missing something?
