I want to take my daughter to texas for three weeks to see my parents. My husband who hates my parents says that he will turn me in for kidnapping and have me arrested. Can he do this. I love my parents and think they have a right to see there grandaugher. He has abused me in the past and i am afraid of what he will do if i say i want to go

Please help

Are you driving or flying? If you're flying, and he calls the police, you can prove you intend to return with a return plane ticket.

He sounds like a real winner. Are you in counseling? Have you considered divorce?

If you are still married and have not filed for seperation or divorce it cannot be kidnapping. You are both presumed to be of equal right to have your child in your care and since you are not leaving the country I don't see that there is anything he can legally do about it.

*** Is there a child custody agreement in place?? If so, then you must abide by that agreement. If there are no child custody issues or court orders to the contrary, then you have equal rights to travel with the children and a report of kidnapping would not be supportable.

Thanks every body for the helpful advice. There is no custody agreement in place i am flying and do have prood of a round trip ticket, I have suggested counsling but he refuses he said it will only make him more upset
