Need Advice VA BK

I posted this question under "Fraud" title. Numerous viewers, but no advice?

My sister and her husband (worthless) filed BK in Mar, total dischargeable debt $50K. Had creditors meeting on May 7, listed home for sale May 25. Their schedules list their only asset (home) market value 112K, mortgage loan 117K. Their statement of intent is to keep the collateral and make monthly payments. He then listed their home for sale through a realestate agent for $170K. Mr Worthless has told her that this is legal, I have told her she needs to contact their BK atty, but he won't let her and she's too frightened to go against him! I don't want to see my sister in any legal trouble. Is this legal and if not what can/should she do?

SOMEONE needs to speak to the bankruptcy attorney before they get themselves into hot water. Err on the side of caution. Real estate is always listed higher in hopes of making a profit off of the sale. IF he sells it and gets that kind of profit, the Trustee CAN take it from them. I'm not sure that it constitutes fraud, the attorney can answer that, but it probably is NOT a good idea.
