I have a situation where I signed a year lease with an apartment community. Upon moving in and staying the first night, I woke up with my head super congested. I have been sick since I have been in the apartment and that has only been since March 11, 2005. I complained repeatly about the gas heat system not warming up my bedrooms like it warms my living room. Maintenance has been in and verified with a thermometer that the heat in the bedrooms are 5 degrees colder than in the living room. I explained to my landlord that I already have sinus problems and my son has asthma and I can't live in a place where I have to blast the heat at night just for it to be comfortable enough for me to sleep. They tell me my heat won't go above 80 degrees which means only 75 degrees in my rooms. i need it warmer than that. Can I get out of my lease due to health reasons with no penalty?

Ever try using warm cozy blankets?Plus its April and your in VA.Sounds to me like your having 2nd thoughts and want a way out of a lease.

WOW! 75 DEGREES! What is your gas bill like? I set my air conditioner to 76, and I still want it cooler, but I don't want to pay an outrageous electric bill.

When I lived in Chicago, we never set our heat above 68. It was usually set to 62.

Or move to Arizona. I bet when the outside temp is 80 this summer, you'll have the same complaint about the air-conditioning.

I don't think you have much recourse, making the place more sound with plastic on the windows or whatever to improve your heating is the tenants responsibility.

Even if you heat is included in rent, in most states, a landlord is only required to keep it at 75 so that temp is perfectly acceptable. Either turn your heat up or take decongestants.

I am not sure why you want it 80 in there anyway, higher heat is bad for sleeping and not great for allergies and asthma anyway.

It doesn't get 80 degrees here in the summer... The lowest it drops is about 95 around midnight, then 115+ during the day...

Yea AZ sucks, that 115 is in the shade. You can make breakfast on the side walk at 9 am and that includes toasting the bread.

You mention "gas heat system". Do you mean forced air heat with ducts that deliver heat to rooms? If so, have the ducts been checked? A broken/crushed/disconnected duct line could cause the problem you described. However, it is normal for the rooms furthest away from the furnace to be a few degrees colder. If it's a simply a wall heater, they usually aren't meant to heat an entire apt, unless it's extremely small.
