I was awarded a judgment from a TN court against a used car dealership in TX. I went through the whole process of filing papers, receiving abstract and a writ of execution served against the defendant. On following up the status with the sheriff's dept. of that particular county, I was told that the writ of execution had been rescinded, but couldn't tell me why. I called the TX county clerk's office and was told that a judge had rescinded it, but wasn't sure why, but was instructed by him to refund my $$ for filing. I called the TX county court coordinator and she told me that the judge awarded a judgment to the defense because I failed to appear at "a" previously scheduled hearing there! I told her that I never received anything about it and she told me that the defense attorney was responsible for sending the notice to me via certified mail and she gave me his name and tel. number to contact. I called and spoke with him and he told me he had sent the letter. After I told him that I couldn't believe that a judge would even hold a hearing, much less award a judgment without both parties being contacted of the hearing, he said, "I told the judge that I did not receive confirmation that the cert. letter had been received and he went ahead with the hearing and awarded the judgment. It seems obvious that this lawyer lied to the judge because I don't think that if he would have known I didn't receive notice, he would have not held the hearing. Anyway, who or what agency do I need to contact for this? Thanks in advance.

maybe because your beef isn't with the attorney but with the judge. You need to appeal the decision on the grounds of lack of proper service.
