Hello,


I just want to know my rights as a Tenant to protect myself from eviction?

Facts...

1> I'm on a month to month verbal lease agreement.
2>I'm in the state of PA.
3>The Landlord has given me a verbal 30 notice to leave the property.

Please help me out with the proper eviction proceedures for my state?

whats the problem????get out by the time he said to... and make sure you take pictures and have the landlord do a walk through, and both of you sign any statement about damages.

what? you think you can stay longer......?

DUH next time sign a years lease!

My response:
PA Title 68 L/T Act of 1951 states that L must give written notice, therefore the verbal notice L gave you is unenforceable.

In addition to HomeGuru's accurate response, I add the following $0.02 (overpriced?):

Though the landlords verbal notice is NOT sufficient, he has obviously given you his intention of terminating your tenancy. His next steps could be:
1) To try to enforce his verbal notice. This clearly can be challenged, but you would have to do the challenging... and it would only get you another month.
2) He could realize his 'error' and provide you with a WRITTEN 30 day notice. This could be enforced and you will have no choice but to vacate ON HIS TERMS.

My suggestion would be to contact the landlord and try to negotiate some mutually agreeable termination of tenancy. Tell the landlord that you will save him the cost and expense of court and agree on a move-out date. In return, he will arrange for a mutual walk-thru on the day after your move-out with a signed condition report and you will return all keys, etc. Try to make this a clean, professional 'business deal'. By doing this, you are more likely to leave with some mutual basis and may be able to protect your chance of NOT getting slammed on damages, etc.
In any case, be sure to video or photo the ENTIRE place, especially any items that the landlord could claim as damaged by you.
