To anyone who can help

I reside in California.

I entered a debt negotiation program about a year ago. It wasn't what I thought it would be. A year later I am in worse shape than before.
One of the credit card companies took me to court and was awarded
a judgement.
What are my options now?

I would very much appreciate a detailed answer on this as well as most of my debts are in CA.

I am not at all surprised debt negotiation programmes are not too helpful. I am getting 10+ messages in my yahoo bulk folder every week "offering" debt negotiation. I have to say they all look a bit "shady" - e,g, if you check the full headers to see what IP the e mails are coming from, it is normally some private IP, not the sort of a company server that you would reasonably expect.

I would ASSUME the answers to this question will vary greatly depending on the individual circumstances, such as if one owes assets, receives a paycheque that the creditors can attack, and generally if one can file for BK.
Any help will be appreciated.

99.9% of these debt negotiation/management/settlement companies are SCAMS !! They will definitely leave you worse off than when you started, and for some people that's going some.

You've learned the hard way .. and now you're going to be stuck with this judgement for 10 or more years ! What are your options ?? Pay it ! Call the attorneys and make payment arrangements and GET IT IN WRITING if you make an agreement ! People, for some reason, think doing things over the phone will work.. it doesn't. If its not in writing.. it never happened, especially true when it comes to debt collection.

If you don't make arrangments to pay voluntarily, they WILL get it from you IN-voluntarily. They can sieze your bank account(s), garnish your wages, and go after any non-exempt assets you might have. As long as the judgment is valid, they can KEEP coming after you. They can haul you into court for a debtors exam where you will be required to divulge all kinds of personal and financial information. If you refuse, you can be charged with contempt of court and even jailed.

Its up to you to decide which merry-go-round you want to ride !

Ladynred - I know I asked these questions before and you provided detailed explanations. I am sorry to go back to the same story - but would you mind clarifying it to me?

I was under the impression from your previous posts that

1) if you have a bank account NOT with one of your creditors, you are reasonably safe as to how much the creditors can seize those accounts;

2) even if you don't show up for a debtor's exam AND you are charged with contempt of court, that will result ONLY in a local bench warrant which will not affect your passport, ability to travel internationally etc.....

Am I missing something? It is just that your response here sounds a bit different (well subliminally at least) from the advice you gave me before... i am sorry if I am misunderstanding something.

Then your understanding and impression were wrong. If you are sued and they get a judgment, they can levy your bank account(s) and drain it dry. If that amount doesn't satisfy the judgment, they can do it again - if you're stupid enough to put money back in that account. There are no limits, they can take what they can get until the judgment is satisfied, it doesn't matter WHO you bank with. If they don't know what bank, the debtor's exam will force you to give them that information.

No, the bench warrant won't affect your passort, I told you that already ! This guy isn't going anywhere, he's a resident of CA, unlike you. He CAN be hauled into court, and he can't be arrested on a bench warrant, and they CAN put him in jail. It IS possible - and it has NOTHING to do with your situation. You don't live in the US, so even if a bench warrant is issued, they won't be able to get you to execute that warrant. People have been pulled over for traffic violations and ended up in the pokey due to an outstanding bench warrant. That can hardly happen to you.

Ladynred - many thanks for your comment. Last question - I promise I will stop pestering you :) .

From a technical perspective, how does a person with an outstanding bench warrant gets in the nick when he is pulled over by a copper? Obviously the copper enters person's name into the county's database and that bench warrant starts flashing all over copper's radars, correct?

Now - assume there is an outstanding bench warrant against someone in County X where a particular International Airport is situated, and that someone is flying into that airport from abroad. I know you told me that bench warrant information is NOT on one's passport, but when one passes the passport control, i'd assume his/her name pulls out the same amount of info on officer's radars?

Would that mean that someone will get in the nick staright from the airport?
