need help in getting someone to pay damage done to my car

I live on a military base. I was at the commissary and the bagger was loading groceries into my car. She had propped her cart with a rock. The rock gave away and the cart came rolling of the curb and nailed my car doing $500.00 worth of damage. ( I have 2 estimates) I went inside spoke with the manager and she called the cops. I filled out a statement and went to the base legal office who took 4 months to tell me since the baggers at the commisarry are independant contractors there is nothing they can do about it. I have repeatedly tried to get in touch with this individual through her work and she will not return my calls. My car deductible is $500.00 and I think she sould pay this since she was at fault. What can I do to get her to be responsible for the damage on my car?
 


I am asuming you made a claim through your carrier. Have they told you that they are subrogating against the bagger in an attempt to re-coup what they paid plus your deductable?

Remember, commissary baggers work only for tips.

When this all happened the cop told me I could 1) file through my insurance and have my insurance go after the commisarrys insurance or 2) go throught the legal office on base and have them cover the car. When we went to the legal office it appeared that they were going to have the commisary cover the employee. We then called our insurance back and told them we were going through the legal office to have the car work payed for. For some reason it took legal 4 months to reject our complaint and tell us there is nothing the commisary can do. Why they couldn't have saved us all the hassle and told us from day one is beyond me. Can I take her to small claims court? To fix the car and cover a rental is nearly $700.00.
