As I have previously posted: I have received communication from a collection agency (in Texas) attempting to collect on "property owner fees" from an incident of nearly 20 years ago. My then husband and I thought we would purchase some property, signed papers, made a few payments and realized we couldn't keep them up. We defaulted on the notes and figured everything would be foreclosed on. We divorced and he agreed to assume responsibility for all property. NOW, the collection agency is coming after me!
I have sent a request for validation to the collection agency, and they have now sent me a letter, enclosing a computer printout from the "property owners assn" showing a listing of their charges. THAT IS ALL THEY SENT!! Now they have given me 5 days to pay up or else they will "proceed with further collection activity" WHAT DOES THIS MEAN? :confused: I need help!!

Chapter 16 of the Civil Remedies Code in Texas.
§ 16.004. FOUR-YEAR LIMITATIONS PERIOD. (a) A person
must bring suit on the following actions not later than four years
after the day the cause of action accrues:
(1) specific performance of a contract for the
conveyance of real property;
(2) penalty or damages on the penal clause of a bond to
convey real property;
(3) debt;
(4) fraud; or
(5) breach of fiduciary duty.

I would just send them a do not contact letter based on the laws outlined in the FDCP. It seems that the debt is not valid anymore or is un- Collectible. If they do sue, you will have no problem due to the Statue of limitations has expired.

Thank you. Is it possible that these people could garnish my wages over this? That is my worst nightmare. I would be in dire straits should this occur! I would hire an attorney to straighten this out, but I am a woman of little means... :(
