need help regarding emancipation

ok i now that to be emancipation u need to
be at least fourteen years old. im a 17 year old male
You must be living apart from your parents with their consent or acquiescence. at the time im not but i can easly
You must be managing your finances and have a legal source of income. i have a job.
The judge must find that emancipation is in your best interests.
The judge also wants to see that you are in school or have a GED. i plan on finishing high school then going into law inforcement

ok heres the deal. my mom and i have decieded that the best course of action between us is for me to get emanicipated. now heres the question

i work, but not full time. i do however make enough to support myself, and would have no problem working after school. also at this time i am still living at home, but before i get emancipated, should i find a place to live. and does live meen with friends or does it have to be an appartment.
another thing is if my parent agrees to the emancipation does that make it any easer.
and the final question is at this time i have a case (minor in possesson of alcohol) i plan to pealed guilty to it. also i had an illegal wepon charge against me but will be able to get it droped.
this emancipation is due in part to the fact that my mother and i dont get along at all, and to the fact that we both agreed this would be the best thing.

also any other advie to maby other actions i could take. i have a lot of support behind this, including a counsler who told us about emancipation

You would need to be self-sufficient enough to be able to afford to live alone (i.e. not with friends/roommates), pay for transportation, clothes, utilities, food, health care/insurance, entertainment, and so on. I somehow doubt that you can do this on a p/t income. In addition, your MIP & weapons charge may well turn a judge against emancipating you.

Yeah I really do think that the MIP and a weapons charge will turn a judge against emancipating you. Emancipation is saying that you are responsible and mature enough to live without the support of your parents, by getting a MIP and a weapons charge proves that to the court you probably aren't mature enough to be on your on.

I would also look into your record, if your planing on going into law inforcement, you might want to make sure the charges that were held agaisnt you, wont affect you getting into law inforcement.

How long until your 18? Once your 18 your free to leave your home and live where ever you want.

Just out of curiosity, why not wait until 18? You have one more year to go (or maybe less) and that will probably give you some extra family support (gives you a little longer to live off your parents).

ok for the illegal weapons charge, i will be getting that dropped due to the fact that i got involved in a program called restoritive justice. and as to my p/t job. i meen its part time now, but i can get room and board for working there(YMCA) as to the mip charges i plan on pleading guilty and taking the consuqences. and as to why i dont wait till im 18. well my moms a single parent, and realy cant deal with me anymore. i offered to look into emancipation, and she agreed.
my grades in school are pretty good a-bs and i live in a small town. its not one of thoses cases ware i hate the parent or anything, we both agree this is for the best. and as to being able to prove i can be an adult, iv held down a decent job($8hr) for almost 2 years, working on call, part time, and full time when i can. as to helth insurence i can get that from my job as well as food. i dont need transportation, cuz i have a bike and prefure that to cars anyway. and by the way i pay for everything i own, including a lot of my food.

maby an alternitive to this question is what can i legaly do to move out. i have the consent of my mother. o ya im adopted. so if that helps in any way, please tell

Your being adopted is moot. :confused:

If your mother agrees with you moving out on your own, you're likely fine.

$8 an hour isn't going to get you far. And.... uuhh... try to spend some time in school working on spelling.

I think you can pretty well forget emancipation - with the situation you described in your other post, no judge is going to consider you mature enough to be on your own.

If you mother chooses to allow you to move out, she can do so. She should, however, be aware that she is responsible for you and your actions until you turn 18, regardless where you live.

i am in a similar situation having a 16 yr old in my home with parental permission. We have consulted a local legal service and were told as long as there is parental permission and that the child is taken care of and has a way of earning a living that all they need to do in Colorado is stand up and state " I emancipate myself" i am looking to see if that is a true fact..

all answers and advice on this subject are welcome
