I posted last week about my grandchildren.
I was told by Ohio attorney I called last week this case with my grandchildren who were moved to Kentucky by an unfit mother and the abuser she married, needs to be heard in Kentucky courts, as they now "reside " there.

After MANY phone calls to Kentucky was told Sat morning by the 3rd Kentucky attorney that this case belongs in Ohio , as they have only been gone 5-6 weeks.

After waiting all weekend to call back attorney in Ohio. I was now told that they are not residents of Kentucky , but that they RESIDE there as they now have a home address. Even if not residents this case needs to be heard in Kentucky.

Does anyone on this message board know anything about this?
I have been so worried, am willing to head for Kentucky right now.
Or retain attorney in Ohio

Why cant one of these attorneys tell me for sure where I need to retain an attorney where I can fight for my grandchildren's safety?!?!?!?

Thank you so much

It is catch 22 ... legally, under the UCCJA, the case belongs in OH. Once you have won a judgement in OH, then you transfer that to KY to have it executed. It is the only way to ensure you are not met by a brick wall later on. You see, if you file in KY, they can argue that the state does not have jurisdiction and throw it out.

Have you heard back from CPS ?

Yes..we did..I posted this under the other post. perhaps by mistake, not knowing how the board works, as I'm new.
Here is what I posted:

I was very upset.
We did hear from Childrens Services in Kentucky , who have been faxed all information on this case.

They went to the home.
They had eviction notice on the door.
No furniture but a plastic patio table.

They were all sleeping in the same bedroom, on one mat made out of blankets. No crib for the baby etc....

Daughter is working. Man is not. he watches the children while she works Plus overtime. Then has total care of children, as she sleeps most of the day to be able to go back to work.

BUT...the apartment was "somewhat" clean.
The kids were "somewhat" clean.
There was food in apartment.

They left them there.
End of story.

How can they?
