Went to court for a upward modification for child support against the non-custodial parent. To date he hasn't seen the child, so he has 0% visitation. She is now 6, the last time he saw her was when she was 8 months old. he never came by only to drop off gifts for birthday and x-mas. At the hearing, he was ordered to pay $600 in child support. He refused to sign the papers and said that he shouldn't have to pay because he doesn't even see her. The last time he asked to see her was back in Dec.00 because he got served the papers for a modification review. I said no and told him if he wanted to see her he would have to take legal action. And he didn't. I felt that he didn't have the right intentions to come back into her life, and that he would be a flake. The D.A. told him that they would have the case continued so that he could retain counsel.
My question is, what if he doesn't retain counsel? If he does try to get vistation, he can't have her stay with him over night because he lives with his parents and bro/sis. There wouldn't be any room for her to sleep. If he does get visitation he would only get to take her out to lunch or dinner, and I would have to come because my daughter never met him. At what % does that leave him? Visitation & child support are 2 separate issues, but can a judge grant him visitation at the modification hearing? What options does he have? And what options do I have? This is in the state of California-Los Angeles county. IAAL, please help... Thanks

I think you should talk to the family law section of the los angeles legal aid foundation.
