I am a college student in SC. I signed a 12 month lease for a garage apartment behind my landlords house. After moving in, I noticed a profuse roach problem. After much coaxing, I was finally able to get my landlord to pay an exterminator. Now I have a new problem. I asked my landlord if it would be ok for my girlfriend to move in with me. He told me that it wasn't because he would have an increased sewage bill. My girlfriend is having financial problems and we would very much like to move in together. How can I end this lease?? I am only 2 months into it.

Please help!

he won't accept more money

I tried to offer him more money. He refused. Any other suggestions?

This one is very simple....
You signed a lease promising to pay the landlord a specific amount of money in return for him letting you have exclusive use of his property.

Assuming that the lease is valid, this is a CONTRACT and you cannot just 'terminate' it at your convenience. Pay your rent, don't let your girlfriend (or anyone else) move in (no matter how convenient?) and accept YOUR responsiblity for the full term of the lease.

And if you don't, be prepared to pay the landlord for your breach.

The only possibility is to ask the landlord to start advertising it, so he can get a new tenant in at a higher rental, you would be responsible for paying for the ads..out of your security, as long as the landlord does not lose any rent on you this could be a workable solution.

Of course you offer to show the apartment, and to keep it clean so it can rent fast.

first of all, its a contract to pay rent and to maintain the place that you live in a condition equal to of better than the day that you rented the place ONLY!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
NO ONE can tell you who you can live with or live with you in any of the 50 states and 2 providence's in this country, you can have anyone there that you want you can have wild 150 people orgies all day long and as long as there is no damage to place, the landlord can't do a damm thing, he only has control over PETS (cats, dogs, snakes, etc.) so let her move in and to hell with the sewer bill, hes your landlord not you mother, or god, there are state statues reguarding this, go to barns and nobel, look in the law section, find a book called Landlord Tennant for you state, there will be a page in that book that will give you web addresses and go to the one for you state and occupancy, so live, love, rock the walls, and most of all PAY YOUR RENT, you'll be fine.

Most written leases provide for restrictions on the number of allowed occupants or even the number and extend of 'visitors'. If your lease includes these restrictions, they are BINDING on you since you accepted those restrictions when YOU signed the lease.

If you violate the lease, the landlord can take action based on the lease provisions. This could include anything from charging an extra fee, all the way to it being 'breach' and being able to evict you.

Do NOT listen to "December". DO read your lease and comply with it. It is a CONTRACT and violation of that CONTRACT can bring allowed 'penalties'.

My response: The above information is incorrect and the advice from Halket is correct. I am a real estate attorney and know L/T laws. This poster December does not know L/T laws and does not follow posting instructions.

i do not claim to be the expert here this is advise right ? anybody can say they know the law and they are a lawyer but facts are still facts arent they? anyway a person has the right to follow whatever advise they want to so i dont not think you should be knocking my advise unless you know the law in this persons particular area and the whole situation. if you are a lawyer you are not representing yourself too well and you have way too much time on your hands to be handling too many clients now huh? just my opinion which i thought correct me if im wrong mr. LAWYER is what this board is all about.

**My response: Fact and Law- the lease agreement states the names of the legal tenants and any indivdual that is not named on the lease is not a legal tenant. Therefore the Landlord can indeed restrict anyone that is not on the lease. So in this instance, the landlord can tell you who you can live with. It is the right of the landlord to do so pursuant to the law.

My original response was based on applicable L/T laws in the State of South Carolina.

My response: You are wrong. Totally wrong. And that is why the readers of this website need to know and be made aware of, that your advice is not at all correct. Readers must be cautioned not to follow your made up advice.
You have underestimated the intelligence of our readers.
Do you really think that they will believe your bad advice. Do you think that our readers are going to listen to someone that can not spell correctly and has absolutely no knowledge of any State's landlord/tenant laws?
Read your posts again. You act like an expert but have no doubt proven that you know nothing of the pertinent State Statutes. Absolutely nothing.
In the future, I suggest you read the landlord/tenant laws of your own State so you have a clear understanding of the real and true facts.
Then read and understand the Statutes of each and every State that the respective writer is writing about, before you respond to the writer's post and look like a fool. That is, if you will be posting again on this website.

first of all i am not posting to impress you and secondly if you have read any of my other posts of which there are exactly 30+ then you would see that nobody seems to be complaining about my so - called bad advice. i will go head to head with you any day because i for one know my rights as a tenant and i know what landlords rights are. you know nothing about who i am or what i know so lets not make this personal okay? as for spelling grow up and get a life look at any of my other posts okay. i never claimed to be like you idiots who really do give bad advice. unlike you i do not make these peoples problems seem idiotic and i am trying to be helpful so you can go stuff it. :)

Go back and read your OWN posts. Please show us ANYWHERE that you have provided ANY REAL advice, other than "Read your lease." and "Read your laws". Of course no one is going to 'slam' your advice... since it is so obvious and in agreement with EVERYTHING that we have already posted.

You come on this forum, full of piss and vinegar, all seeming to stem from the FACT that you took offense to advice offered to you. [I have to note here thought that your FIRST post claimed that you were given wrong advice. But since this was your FIRST post, you either were lying about a claimed earlier post, or did so in another name. Either way, it tells a lot about you....
