i assume that made you feel better. first of all i do not even agree with your advice so why on heavens earth would i follow it? or copy it ? and every person that popsts a question on this board can take advise for what it is and follow whatever path they want but i guarantee they will get alot further with my words and opinion than they will with yours or some of these other sarcastic dummies.if your so concerned maybe you should do follow- ups and find out if ANY of your advice was followed and even if you were remotely correct.you slam me because i have an opinion but i have noticed that the more posts that the person has the nastier they get and not even dealing with the issue. so is this a board to deal with landlord tenant questions or a board to air out your negativity?why dont you lay off!!!!!!!!!!!!!!!!!!!! half of the posts that i have posted havent even had a response from you so just get the !@#$ off of my back. i have a right to give my opinion do not think for one second your word is law, golden or even correct. you have the right to say what you want and so do i there only one difference i ask all of my posts to let me know how it goes. is it that you just dont give a crap or that you know your advise is not correct and cant back it up?????????

I was trying to find your first post asking for advice, but was unable to locate it. You seem to have a lot of hostility based on the advice you received when you first came to this forum. I wanted to look over the post to see what had transpired.

I do find that much of the advice is correct, but I do not always agree with the advice on this forum. Happy Lucky comes to mind--he disguises his flames as advice & likes to be contrary rather than accurate (I read his posts with the same attention I give the funny pages. No disrespect to Happy I think his posts are a fun diversion, but I would not take his advice seriously.) Sometimes states vary in the landlord/tenant codes and that could be the cause for the discrepancies in advice.

I do think Halket & HomeGuru generally give helpful and pretty accurate advice.

Basically I just wanted to let you know that the attitude (hostility) that you display in your posts deflect attention from the advice you are trying to give. If you want your advice to be taken seriously, it would be helpful to be respectful in tone & not to bash the forum in general. Others seeking advice may not take you seriously when you constantly berate this forum and in essence state it is useless. (If it is useless, why would anyone bother asking for advice?)

I am not posting this to start a "flame" war. It's just that I would like this forum to remain as a resource for those seeking advice. I find this forum to offer a lot of insight into landlord/tenant relations & have learned quite a bit that has helped me in real life (even the poor advice).

The only answers to my questions have been, "Move Out" or "take him to small claims court".
If I wanted to go through all that trouble then I wouldn't have posted my questions here. I have read several posts and all say refer to the landlord/tenant laws but none have been quoted.

The sarcasim and rudness from some of the senior members is
obnoxious. Those who post are not dumb and you treat them as if they were. I am extremly educated but noone can know everything. I'm sure if I asked you guys the first thing about my major in college or one law about what I do for a living, you would be dumb founded. I deal with attorneys everyday and most of you have one thought and one thought only.....You think because you have a law degree that you are above everyone else...Well I guess your wrong because apparently none of you have wifes, girlfriends, or even friends to be on this sight 24/7.


Think about it, if you were that great you would have paying clients and not be posting your jargon on a free websight day after day.

I'll agree with you to a point. That is.......it is true that Halket and a few others have known to be condescending and rude on this forum. Halket has even chapped my a** a few times. However, I'll have to admit Halket is right on target on this one. I'll also have to admit that I have noticed a huge difference in Halket's temperment in his/her latest responses. Lately, I have actually enjoyed reading Halket's responses.

I may not be an attorney, but I have been a tenant for 17 years. 15 of those years in California. When you are a tenant for that long, one tends to learn what the state laws are. The other way I learned is by reading my lease. The lease for my last place of residence in CA (I lived there 4 years) states "Only the parties listed as Resident herein shall occupy the premises and the premises shall be used as a residence for not more than 2 persons. Occupancy by guests staying over 15 days with the written consent of the owner shall be considered a breach of this agreement."

Now that I live in TX, my lease states "No one else may occupy the apartment except for the person (or persons listed above). Persons not listed above must not stay in the apartment for more than 14 consecutive days without our prior written consent, and no more than twice that many days in any one month."

As you can see, the landlord CAN tell you what you can and can't do in your residence. However, one must read their lease to know the exact details.

Decembersgirl, please don't get me wrong. I respect your opinion but I am curious where you got your information regarding L/T issues.

I have the Tenant's Rights book for California and it clearly states that the tenant must abide by what is indicated in the lease. If there is no lease and the tenant allows a guest to move in without notifying the landlord, it could only complicate things. When the landlord does find out, he/she may assume that the tenant is being "sneaky" and slap them with a 30 day notice.


I'm hoping you'll consider extending the olive branch on this one.

Oh my gosh! This is a hoot!

Decembersgirl - I couldnt find your post either (the one where you say you were given the wrong advice), but i do know this - you are wrong about this one. I just signed a new lease today, and in the lease - it plainly states that no more than (4 in my case) tennants can occupy the premises.

I have only ask advice once - and i will say that when i did - Happy & Lucky chewed me to bits - but after further conversation - he gave me advice, and it was right. So, dont jump on me - but maybe you should lighten up.

Happy&Lucky may be right about the advice...............

but as the saying goes..............it's not your text, it's your presentation. Now if H&L could only learn that you don't have to "chew one to bits" in order to give advice.
