need to get power of attorney for grandmother with alzhiemers

My grandmother has moderate alzhiemers/ dementia and is being taken advatage of by my aunt and her three children ( who have children as well.) They have all moved into my grandmother's home, she is not capable of comprehending the fact that they are living there. She complains to my mother of wanting them to leave, but when anyone tries to help her confront this aunt my grandmother backs down because she is afraid of this aunt. My aunt and her children have no jobs, pay no rent and spend my grandmother's social security money. They are all drug users and frequently have strange people showing up at all hours of the night. My grandmother is frightened by this and as I said is frightened by my aunt. What options do my mother and I have to resolve this situation? We feel that my grandmother needs to sell her house and be placed in an assisted living facility for people with alzhiemers.

My response:

You cannot obtain a valid POA from an Alzheimers sufferer - - just like such a person cannot make a valid Will. A person giving up their rights, or making promises for the future, must be "in their right mind".

Therefore, your only alternative is to file a Petition in Probate court for "Conservatorship". That way, when the court makes its order, you can legally handle all of her affairs, including all income, and her real estate.
