What is the name of your state? Illinois

I have a daughter that is 15 months old. Her father and I were never married. I want to move to California, and the only thing that says he has any rights to her is an order of protection. I can drop that, and it would be void, so would it still count? Is there anything he can do if I did move out of state? He has a new girl who hes marrying and son with her, and has pretty much abondoned my daughter. I just need to know if I can move out of state without him trying something. Thank you for your help!
 


Are you saying paternity has never been established? No DNA test...no acknowlegement of paternity signed at the hospital...nothing? If not, then legally he's not the father and he has no rights. You can do whatever you want.

Keep in mind, of course, he can decide to make it tough for you and file for custody/visitation/establishment of paternity. That's a whole different can of worms!

Does he pay any child support? If so, is it court-ordered? If it is court-ordered, paternity was probably established and then he has rights like any other Daddy, including the right to insist the child not be moved across the country.

just to answer ur questions.....

Yes he signed the papers at the hospital but things are a lil complicated for me cause i have a Order of Protection against him for abuse!!! so the only thing ordered was surpervised visitation! But he doesn't follow the Order of Protection at all!!! So he is just doing this to piss me off!!Yes child support is court ordered the state took him to court (public aide)!! I am so confused!! I don't understand but the police told me that I have full coustody until he takes me to court! So I really need to know if I can legally move to California? Thanks for any help u can give me!
