In Brief: my daughter received a DUI in July 05. While waiting to be released the sheriffs dept. put a mentally ill woman in the cell with her and others. The woman claimed my daughter "disrespected Jesus" and grabbed her by the hair. She threw her into the cement wall injuring her back, neck, and head. This is all on videotape as well as the womans statement of guilt in the report. She has pictures of her bruises. The officer also told my daughter she should have never been put in a cell with others.

She filed a claim against the county that was rejected in January 06. She spoke with an attorney who said she did not have a case because detainees cannot sue the state. Then she said "don't take my word as gospel." She said to speak with a civil rights attorney. I am not sure why and wonder if she really knows what she is doing.

Does she have a case against the county and should she seek a civil rights attorney?

Any help is greatly appreciated.

Maybe the crazy woman will ask Jesus for the money to pay your daughter.

Anyone who gets busted for DUI deserves to get thrown into any cell available. Just where did "the officer" suggest your DUI daughter be placed...the nearest hotel? If she was mouthing off and cursing using Jesus' name, she probably got a well deserved wake-up.

Have your daughter contact a civil rights attorney to see if she has a case. If there were no permanent injuries, however, it is unlikely that you will find a lawyer to take her case.

When one makes a mistake, they learn from that mistake. No one is perfect so I would beat you have done things in your past you are not proud of. If you read the post properly you would know she was not mouthing off, and NO ONE DESERVES TO BE BEAT UP. It is very obvious what kind of person you are you and what kind of life you lead.

Thank you for your advice, it is greatly appreciated. I will have her contact a civil rights attorney.

Your ignorance is overshadowed only by your naivete. Your daughter was tossed in jail for committing a serious and dangerous offense. Nothing in your original post suggests that she wasn't doing exactly what the "crazy lady" accused her of. You have already been told by two lawyers there that she doesn't have a case against the sheriff or the municipality.

What civil right do you think was violated, and by whom?

How much are you willing to pay up front for a lawyer to try to make a case out of a "crazy woman's" actions?

Perhaps you should spend as much time counseling your daughter about drinking and driving, and less time worrying about getting even. You and she are lucky she wasn't killed on the road (or killed someone else).
