I was involved in an accident where a commercial vehicle ran into me. After a year of therapy, epidurals,nerve tests and a discogram,I am told that I may need to have my L5-S1 disc fused.

He explained to me why it would be necessary but there is only one problem;the type of skin I have. I have keloid skin;a condition in which a wound tends to heal with massive scar tissue. I am a little concerned that if I get the procedure done,I may risk paralysis or nerve irritation when the wound heals.

Someone told me that if I do not have it, the commercial vehicle's insurance company will say that I am not really injured and do not want to get better. Is this a true statement?

The reason that I ask is that I am truly concerned about the "long term" possibility of complications that can arise.

This may or may not be true. It would be dependent on the reality of your fears. If the chance of this happening is slim then yes they could likely use that argument.

Has there been any kind of settlement with the company owning the vehicle? The reason I ask is because generally they do not continue to pay bills for this sort for years and years and make a settlement based on past, present and future care.

No, there hasn't been any settlement offer as of yet but they are willing to look at the medical reports, according to my attorney.

That is likely so that they can make a fair settlement offer and predict future issues so that it's settled
