OK, im abit confused here. On April 30th, 2003, the lease for the tenants living in my home was to expire. The tenant called me and told me that they want to sign for another year but was wondering if the rent could be dropped. So i agreed to dropping the rent $50. I sent the renewal papers in the mail a full month before the original lease was to expire. They were to sign all 3 copies (one for me, one for my so called agent and the other copy for the tenants to keep) and then mail me back my copy. I get a phone call July 4th, 2004 from the tenants saying they wanted to move out. I told them because this is terminating the lease early, i am giong to keep the deposit to cover the one months extra rent owed to me. They said they wanted me to keep the deposit, but not have to pay for the month of July, which is when they wanted to leave, sometime in July. I told them that the security deposit cannot be used as a form of rent, it says that in the lease. then they come out with "we never signed the lease." (the renewal lease that is) WHAT!? so now i dont know what to do. i never knew that the lease wasnt signed or else i would of told them they had to move out so i can get someone else in there. we never agreed by phone or signed document of a month to month lease. so now im not sure where i stand

can you give me your advise on my responsibilities as welll as the tenants?

I am not a laywer but if they got no lease what do expect to be done? Take them to court at cost a few $1000 to yourself to be thrown out for wasting time. How much are you going loose? Think about it like a mature adult - money+time+fustration= taking this further.

Drop it, mark it to experience and next time you get tennants make sure you get the contract returned. It's your own fault and I wish more landlords were like you.
