New Court Order Plus Arrears

Just to get this straight since we have received so many confusing instructions from the CS Department.

My husband has arrears for 3 months because he lost his job. Once he get a new job, he contacted them to provide new employer's address. They sent a new CS Order (original amount and also part of arrears monthly).

We would like to settle it all once we have enough money, by one or two months since I will start my new job by soon. But for the time being, we cannot pay all. My question is, can they suspended his Driving License even they already have a new order? This will cause him difficulties for him to go to work.

Once the first payment is made via employment, no further action will be taken to collect on child support. You have to be careful about making payments other that what is garnished out his check. I owed about $4,000 in arrears and paid $3,000 via money order. They still took $2,500, which had me at a $1,500 credit. I had to literally sic the dogs on them to get a check back as they tried to get me to apply it to the current support order, which could have changed during a COLA adjustment.

Just have him keep making the regular payments and save the money that you were going to apply to the arrears. That's the best move.

Thanks Tadmartin...I heard a lot of people who over paid and have difficulties to reimburse the overpaid too. It just very unfair, when someone really obey the rules and they make it difficult. But when you really have difficulties they don't care, they haunt you like crazy, make your life miserable, never want to negotiate and be reasonable. I am not saying this to someone who try to run away from paying cs, this is only for those who really responsible and then in their life has something happening to them that they do not plan. Well, thank you...they are going to take the payment on July 1st.

I agree that the court system is very unfair and unjust, but I also do understand that a lot of people try to get over and not pay. They tell you that CS is not biased, but I beg to differ.

The mother who is owed the arrears would certainly disagree with your advice. 3 months isn't a horrible long time but still it was 3 months without money she was counting on to help buy what the kids needed. She is probable behind herself now..robbing peter to pay paul .Pay the arrears as soon as possible with a lump sum or extra payment- keep copies of the check sent certified. Also follow up with the case worker to see that receipt was made.

That's totally understandable, but the respondent has to watch its back because the court system is unfair. Just because the petitioner has the child doesn't mean that the respondent is living a care-free, worry-free and bill-free life. Even if he sends the checks CM, that doesn't stop SCE from making the mistake of not checking their records and still garnishing his arrears AFTER it's all paid up. Then, they take their sweet time about cutting a check from the overage. Then, how does he pay his bills? His rent?
