Legally, as you have admitted, it is not illegal, it is moot, there is no cause of action on what might have been possible, the outcome would be the same based on the evidence they had at the time. There are many times when we want something reported, or law enforcement to follow up on it, but it doesn't happen. Law enforcement can't prevent a crime from happening if indeed a crime happened. The most OP can hope for is that they can make some sort of citizens complaint re the sensitivity of the officer and that the department will offer some sort of training or policy change, but even so, they will not be advised of the outcome unless they can get the media to take it on as some sort of a cause.
