What is the name of your state? Georgia

I am a canadian who just married a US citizen. I entered the US on dec 18 for christmas hollidays and ended up staying and getting married on feb 8. I would like to reside in the US while my papers are being processed...would this be a problem? will I get into trouble if I am still here past 90 days even if my papers have been sent in?

any help would be greatly appreciated!

thanks,
gemini8

it has to be after the 90 days otherwise they will say you crossed the border with the intentions of getting married and staying.

thanks for the info

I was thinking that the paperwork had to be sent in before the 90 days was up or otherwise you were deemed to be here illegaly....good thing I found this site! did you get this info from a lawyer or did you find it on an immigration site? I have all the documents....if you need any help with where to get any of those or what papers have to be sent in just let me know.

thanks again,
gemini

That is an urban legend (or more accurately, a mistake drawn from a State Dept memo and propigated around the internet).

Also, Canadians are not typically admitted for 90 day periods.

Most of the people on this forum are merely trying to help others, it doesn't mean all the info is correct.
That's why I don't discuss immigration law matters in private message; mistakes are more likely to be caught and corrected in an open disussion.

Suggest you visit britishexpats.com marriage-based visa forum for more direct guidance. No need to be British, it's just a portal to alt.visa.us.marriage-based
