What is the name of your state?Florida
I have a brother in Indiana that had his wife's niece (from Brazil) come stay with them to go to high school when she was 15. She is now 18 and is finishing school. When she came she had the typical 6 month visa. Of course she has overstayed it.
She plans to go back to Brazil after graduation in May. Will she have trouble if she wants to come back to the states in the next few years? Because she has overstayed her visa, would there be any way for her to 'get legal' and to go college in the states, other than adoption by them?
Thanks

Entry Bar!

Becuase the niece has overstayed her visa over 1 year, IF she leaves the US automatically she will be denied entry into the US for 10 years! I do not believe that she can be adopted at 18 years old. At this point only a petition from an immediate family member who is a US citizen will allow her to get a green card and for Immigration to over-look her out of status situation, ie, spouse or parent.

On another note, if she wants to go to college, some states, for example california say that if an illegal alien attended high school in California for 3 years or gets their diploma they are allowed to go to college in California, even though they are illegal. My advice is that you check with a college in Florida to see if there is something similar!

Hope that helps.

Nick
