No A/C as promised

What is the name of your state? Wa.
Last summer the central air-conditioning went out. We have lived here for 3 yrs. We were promised new A/C. Summer is now almost here and LL says
he don't have no money for new A/C. What can I do? I have bad health and this is detramental to my health. I cannot afford to move.
Please advise.

Is it in the lease/ rental agreement that you are to have an air conditioning unit in your apartment?


He actually said "We don't have have no money"... tell him to go to an english class too. :p

Yes It is in the lease that the Apt. has Cenntral A/C & Heat

Well, I found these two choice points in the Washington Landlord tenant law.

Landlord responsibilities
Make repairs to keep the unit in the same condition as when the tenant moved in (except for normal wear and tear).

• Keep electrical, plumbing and heating systems in good repair, and maintain any appliances which are provided with the rental


You may want to read this link and then write him a letter stating these requirements.. Send it to him Certified return receipt required, with a nice little time limit. Keep it legal, not emotional and do me a favor... use a spellcheck.

Your case is VERY weak... You say you have health issues, but at the same time you've been living there for three years... If your health issue was such a big deal, why didn't you bring it up sooner, like a month into your lease?

Yoohoo Who's... The A/C just broke last summer, they were promised a new one... did not need it over the fall/winter. It looks like they asked again, and were told the money is not there.

The case is not as weak as you have interpreted if you read the post again.

You state that my case is weak. The first year I was here the A/C unit
worked great. Second year, A/C unit broke down. After repeated phone
calls and talking with Manager, He convinced me that the unit would be
repaired or other means would be taken. Our summer runs from May
through Sept. How would you feel living in 100 degree weather? And thats
inside my Apt. If I have to fight this man to make the repairs, I am afraid
he will "make my life miserable". Last year I made a complaint to the BBB
and since then he doesn't treat me the same. By the way, the issue was
not resolved with the BBB.

Has the landlord even had an HVAC tech sent out to assess the problem? "Went out" is a pretty wide description. Could be low on freon and just need a recharge. Coils could be dirty and just need to be cleaned. Does your heat work? These questions could be answered with a simple service call by a qualified tech. The service call should run about $60-80 bucks to find out the extent of the problem. Surely the landlord has that money. If the whole unit is indeed shot, the tech should be able to provide the owner with an estimate to replace the system for that same service call charge. He's gotta start somewhere though.

sometimes it don't). The manager has put more freon and checked the coils.
He says" The A/C is old and theres nothing he can do".

Look up Baby and see who found something you can possibly shove in your dear landlords face.

Look up at the posts above and see... nevermind... I can't be too mad at you when I look at your posts...

I made it a resolution not to belittle some people, I am not sure how long I can stick to it... so don't push me.

The landlord put more freon in? There are strict regulations regarding the type of freon and recovery systems in place currently. What he did MAY be illegal. "Checking the coils" does nothing. They need to be cleaned (professionally) or the unit won't work correctly. If the unit is simply not putting out much cold air the compressor may be shot. Depending on the age of the unit, you could replace part after part, pretty much until the costs equals installing a new unit. Not too smart on the part of the landlord.

I try to save my customers some money by having them check a few things first before I send out my techs. 1. Is the filter clean? 2. Try unplugging the unit, wait a few minutes, then plug it back in. Some units can reset themselves (depends on age of unit). 3. If you have a programmable thermostat, check the batteries. Lastly, here in CA you can call PG & E and have them inspect the unit for safety and operation for free. I don't know if Washington has something similar. Do you have a carbon monoxide detector in your apt? They cost about the same as a smoke detector. If the unit is old, sometimes the combustion chamber can develop cracks from years of expanding and contracting. A cracked chamber emits carbon monoxide and can cause illness and death. Carbon monoxide is invisible and non odorous. What are these health problems you mentioned? Flu like symptoms, dizziness, headaches, etc? You may have more of a problem than you know. If your unit is unsafe, it will be red tagged by the utility company and the landlord would be forced to replace it.

Now between ENASNI and myself, you've been given leads to pursue. Get on em before it gets really warm or you don't wake up.

You just keep trying to please and OY whatever... You sure know your A/C units. Maybe some people can not be helped?
