My mother passed away a few months ago and we can not find the original will? Do we need the original will?

You'll find probate statutes for FL in Estates and Trusts at www.flsenate.gov/statutes

Only a certified copy is acceptable which can only be done with the original copy. Have you checked with whoever drafted your mother's will? Without the original will, the estate will be probated as intestate.

Unfortunately, yes I did check with the individual that drafted the Will and he doesn't have the original. He also just informed us about the same info as far as if No Original, then intestate. Thanks for your help!

In Illinois; if a person passes away and left no will or power of attorney of any kind; does his assests/debts/properties automatically go to his spouse or does the State take over?
