No Word From Executor Re: Estate

Hello. My father passed away last April, and on June 2 my sister's husband was named as executor of his estate. My mother passed on 9 years ago.

I did receive a copy of the notice of their court appearance, and I was listed as a beneficiary. Since the process began on June 2, 2003, I have not heard anything regarding their progress of settling his estate. I also have never seen the will, and I have no idea what it says or what I am entitled to.

Due to circumstances too lengthy to get into, my sister and brother in law and I have not spoken in almost 10 years, although we have kept each other informed of our whereabouts. Since this is approaching 10 months, should I write and ask for an update? I'm sure the estate was not very big, there were only 5 or 6 creditors listed on the petition, myself and my sister.

The executor is a very experienced attorney and I do not want to seem naive about the subject before rushing in to ask for a status update, if that's what I should do.

One other thing I might mention (for some reason I keep thinking about this), is that I live in a large apartment complex. The executor initially tried to contact me and they neglected to put my apartment number on the documents and they were returned to them. They did eventually obtain my apartment number and I received the court documents related to the appointment of the executor. However, the paperwork still listed my residence without my apartment number. Our post office returns any mail sent to our complex without an apartment number on it. Does the executor or the court send out notifications or settlement information? If it were returned to the court as undeliverable, would they simply cease any effort to contact me? Also, I am unable to travel to the court where the will was filed. How do I get a copy of find out what's going on (an accounting)??

Thanks for the help and advice. I'm totally lost, and our family's lack of verbal communication has made this more difficult.

Since you have a copy of notification of the appointment of the Executor, you know the court where the estate is being probated. Use 411 to find the phone number of the court clerk, give him/her the case number and ask how much it would cost to copy the file.

Send them the payment and you will receive a copy of all papers in the file. You can also amend your address in the probate file to the exact address with apartment number where you receive information.
