Take the issue of whether it is appropriate with the HOA in accordance with their by-laws. < Heres the scoop some states hate to pay for placements so they have very strict rules, in order for this young man to be placed into a group home since he is not doin SIB and has not shown physical aggression to anyone in the development or committed property destruction then his parents are gonna have to DIE or become so incapacitated that they can no longer care for him ! thats it in a nut shell for him to be placed now unless the parents are so so wealthy they can private pay for him to be in a group home ( we have one client that im aware of whose parents left a trust fund to him that could pay for his care if he lived to be 120 yrs old trust funds like that are rare at best) NOW if the HOA goes after the parents because of his verbal aggressions then I suggest they make damn sure they have deep pockets because like it or not this young man& parents have legal rights that are just as important , My best suggestion is that the HOA offer to buy the parents out, WHY so this way they can find a single family home that would meet their needs Other wise what I see would be such a long dragged out legal fight between the HOA and the parents and mars forbid if a attorney who has alot of experiance with developmentally disabled and their legal issues represented this young man I suspect this HOA s member ship would be bankrupted by the time it was over. Side note here often its sad to say DD who are younger and cant get along with parents but have been living with parents all there life get kicked out because of disputes or told they cannot come home after a stay in crisis care but that does not get them into group homes, ( the house i work in has a 20 yr old who was living in shelters, not regularly getting meds and limited access to DRs because his parents kicked him out and he didnt meet our states criteria to be committed (court ordered) so after being hit in a cross walk by a car and hospitalized finally he was given a case manager/ social to assist him , he is not court ordered to be where he is but if it was not for being hit by a car while he was in cross walk he likely would still be on the streets )
