First i would like to mention that I have lived in several apartments and undertand that from time to time you will hear your upstairs neighbor. That is natural.
However I have recently moved into an new apartment and I believe that the noise from upstairs is unreasonable. Specifically I can hear all my upstair's neighbor's activities clearly. Specifically in my bedroom. I can hear conversations verbatim. I have heard of a place with thin walls but this is ridiculous. I have normal hours and try to get to sleep every night around 11pm. I am unable to fall asleep at a reasonable hour every night due to my upstairs neighbors phone conversations which last sometimes well past midnight.
Had I known this prior to signing my lease, I would have never done it. Don't they have a responsibility to provide a quiet envirnomrent or to reveal the potential noise levels prior to entering into a lease agreement. I have called the mgt. company once and asked them to let her know she is keeping me awake at night. They said they would follow up with me, but they haven't.
It has come to the point that I have been sleeping out in the living room to get a decent night's sleep. The next step I am thinking is getting a prescription sleeping pill just to fall asleep quickly.
What are my options? Certainly my upstairs neighbor is entitled to use the phone. I don't think she is violating any noise ordinanace since she is not blasting her music or TV.
