What is the name of your state? New York My husband and I currently have a lawsuit pending against a church in NY State. My husband was injured while working for a construction building a new church. After the lawsuit was begun, the church began bankruptcy proceedings. Our attorneys did not file a timely notice of claim. Are they negligent for that?

Sounds negligent to me.

Our attorney says that the lawyers for the church sent everyone notice EXCEPT our attorneys in an attempt for this very thing to happen. However, we are not the only people suing that are affected by this bankruptcy and the other attorneys filed a proof of claim way before this notice was supposedly not sent.
