What is the name of your state (only U.S. law)? Missouri

My employer's scheduled pay days are Friday of each week. However, he has not paid anyone the last two paychecks. He keeps promising that we will get paid but the promised days have come and gone and still he has not paid anyone. People want to quit but are afraid of not being eligible for unemployment benefits. I would think that this should be considered a "quit with good cause". Does anyone have any advice or know what the laws are in Missouri regarding wages and unemployment benefits?

Missouri UI law does not address this situation directly. My advise is 1) don't quit; 2) file for UI (it's not that you're not working, but that you aren't getting paid. Generally speaking, althought the Missouri DOL will investigate failure to pay minimum wage (which, in this case, theoretically applies), you would probably have to file a civil suit. But contact the state DOL first.

second pattytx suggestion of filing early.

If your employer hasn't made payroll in 2 periods - I would not be working there. UI or not. No way. I would rather use my time productively finding another job and not getting paid than to continue to work as a slave.

Do you and your coworkers think magically one day your boss is going to have this huge check for you? This happens a lot and what it sometimes turns out to be is that the employer is bankrupt and running on empty until the creditors come and start taking stuff.

FIle, and search for other work in your free time.
