Not the father!

I have been named as being the father of a child born in 1985, the State of Maine started proceedings in 1991 just over six years from the date the child was born to have the courts acknowledge me as the paternal father. I am not ! When proceedings were started I was incarcerated and received NO notification by mail or otherwise as the correctional center refused the certified letters. I was contacted again this year several months ago and told that they would suspend my drivers license if I did not respond. In their letter they stated that I had to do any ONE of several things to keep from losing my right to drive. They received an answer from me via certified mail and responded stating that they could do nothing about it and that I had to take it to Superior court. I then received another letter stating that if I did not start paying the weekly payments and make arrangements for the back support that my license again would be suspended, once again I answered and still they suspended my license. Now I cannot drive to get to my doctors appointments, hospital for tests and not being able to work or collect dis-ability have really put me in a bind. My wife is the ONLY one working and we are just making it. I did go to the Volunteer Lawyers Project and they say that there are too many issues for them to help. I need someone to help me on this. I will state , I am not the father of this child, just a convenient name because I was nice enough to buy someone dinner and drinks. She put my name on the birth certificate, I have never signed anything and have denied this since day one. I would like to know if you can help?

go back to the volunteer lawyer project and tell them you want to petition the court for two things:

1. a certified copy of the birth certificate

2. a paternity test.

I petitioned for a certified copy and was told because I did not sign the birth certificate that I could not have a copy. I will NOT ask for paternity testing until the other men that could have fathered this child are also tested as I feel it is an invasion of my constitutional rights to equal protection under the law, that it is an invasion to my privacy and that due process is not being served. The state automatically deems the mother is telling the truth and bases their findings an her alone. What else can I say.

To answer withonel, please tell me how someone can become pregnant without intercourse, oral sex only, then tell me what a joke! The constitutionality of paternity is and has been challenged for issues of privacy, due process and several other points if you have been up on the law. And to the comment " say goodbye" I have already done what you reccomended, the state says that I have to pay for the testing, so now what? An NO the Sate of Maine will NOT give a certified copy to anyone that requests it.

If you have been found the father by default, that will never change until you prove otherwise. The only way to prove otherwise is to have a DNA test.

So, you can either live without a drivers license and a huge chunk of your income for many, many years until support, including interest is paid in full, or your can prove you are not the father by taking a DNA test. It is a small price to pay versus years and years of child support, jail time, license revocation.......
