What is the name of your state?What is the name of your state? Mother resides in Virginia.

My unwed girlfriend is 3 months pregnant with another man's child. She currently resides in Virginia, I currently reside in North Carolina. We plan to marry before the birth and raise the little one in a home full of love.

What are the father's custody rights? What will visitation most likely be? Can he force her/us to remain in Virginia?

Fathers custody rights

An unwed mother has sole custody. If paternity has not been established then the father has no legal rights to the child. Even if paternity has been established the father would still have to petition the courts for shared custody or visitation rights. Paternity is established by a paternity test or by signing an agknowlegement of paternity. Paternity would have to be established to file for child support.

If you marry the mother before the baby is born then you will legally be the father of the child. If you are legally the father then I really don't know what rights the bio father will have.
