Jpony You got what i was saying exactly right thank you.. i'll make sure she pays her rent for this month. and try and have her moved by the 20th.

Do you (or anyone) know if she still has to give a 30 day notice and if she moves out on the 20th will she owe rent for May I read somewhere that if the apartment isn't ready to rent by the next month the person owes rent for that month.. should 10 days be enough?

If you think, Maybe... if the moon is in Gemini than you can pay rent.. Then the apartment is yours.. BUT... if the sun is in Scorpio you must pay 5 times the rent unless the saturn moons are not in synopation... it is really important

IF she is also on Section8, then there are certain eviction procedures he must follow according to their lease agreement which he had to sign to start getting his rent check from them.

The housing authority should be aware of the situation and they can also advise her on how to handle it and help recommend new landlords to contact and ways to get money to assist with moving.

IE: In Pa, our Section 8 lease says the landlord must give 15 days notice between April and Sept. and 30days during the winter months, and that is before he can take it to court.

She should have the stipulations relevant to CA in her Section 8 lease and if she has lost it or can't find it, just call the housing office.

P.S. I think if all planets are in alignment then it's a year rent free! LMAO!

I have evicted section 8 before in California and its easy to do if tenant has not paid their portion of the rent even if its one cent owed, you simply inform section 8 that a 3-day notice was served and the tenant portion of rent was not received and then file the unlawfull detainer no different to a normal non-section 8 eviction.

Is this relative capable of taking care of herself. I mean having to pay move in fees for the 3rd time sound like a pattern that will continue. Do not blame the landlord because the fact that this is the 3rd eviction tells me that this will continue. Since this person is mentally ill and on section 8 is there anyone who can take over like a caseworker who can train this person with classes so this doesn't keep happening again and again. Each time your relative has to move it is going to be harder and harder for her to find a place to rent because landlords do check out references. Each time you pay again and again for them to rent someplace IMO you are enabling her. You need a solution not a bandaid. I am not trying to be mean but I am pointing out facts. My suggestion is if your relative keeps getting evicted maybe a group home would be a option to look into
