Nude Picture of Me at work

Georgia,I am a manager in a retail department store. Recently I was informed that a associate in the cosmetics department claimed that they found a nude picture of me on the internet and was telling the other associates in the department about it. A few days later I heard that the same associate had printed the picture out and brought it into work and showed everyone in the department. I have not seen the picture but I do know that there is a nude picture of me posted on the internet. If this continues can the executives take any action against me? I did not tell anyone about the picture or admit that the picture is me and will deny any accusations if confronted. I am worried that the HR Manager and Store Manager will hear about this and terminate my employment.

Thanks for the help, your quote has really made a difference. I should just run around saying "Yep thats me, thanks for bringing it into work" :mad:

That would put them in a prediciment now wouldn't it? Fire an employee for posing nude on her own time or fire the employee for bringing porn to work. which would be more likely to be against company rules? They can fire you for any reason.

I would assume that the associate bringing them to work would be more likely to be a fault since there is a clear policy about pornographic material in the workplace regurdless of who is in the photo. I did not do anything against company policy but I know that it is not a right to work state and I can be terminated without reason, it just sucks that I have dedicated 4 years of hard work only to have some chuckle head find a picture of me that was taken a long time ago and thinks it funny to bring it to work. I think I am more confused about what the next step should be. Should I be pro-active and bring my issue to HR and then it definatley becomes common knowledge or do I do nothing and hope the whole thing blows over.

You realized when you posted a nude picture on the net, where you could be identified, that you could be identified, now just what were you thinking?

You work and live in an 'At Will' state. I suggest you read up on your rights (or lack thereof) regarding that issue.

As to the person bringing such things into the workplace, IF it happened and you are not being told a rumor AND it is proven, then such an action can get them fired at the least AND be the basis for a hostile workplace complaint.

YOU, however, have nothing since you have not seen the photo, been approached with the photo or been subjected to it. The ONLY thing you have been subjected to is rumor, which is NOT actionable.

A nude photo of you on the internet is in the public domain. Anyone can access it. (Something to think of before you post a nude picture of yourself on the net and/or allow such photos to be taken.)

If you're wondering whether you have any legal recourse against the person bringing the photo in, the answer is no. Company management may certainly take exception to the individual who brought the photo in and discipline him/her. They may also take exception to your having such a photo in the public domain and perhaps the venue in which it is posted. If they feel that impairs your credibility as a manager, yes, they may terminate your employment.

I cannot believe the replies that you have gotten. Don't deny it, be proud of your body and self. Never let them see you sweat. Perhaps the internet sight should have not posted the picture.
I do not see why a company would fire you for something as common as this....this stuff is everywhere.
Tell if they do fire you, you will have to sell them the shots next time!!!!

I do not see why a company would fire you for something as common as this....this stuff is everywhere. Are you kidding? Nude photos of anyone at work is grossly inappropriate, much less a manager.

The person who brought the photo in is the one I would consider going after. Going after him for what? As I said above, the nude photo is in the public domain. Anyone is free to print it out and pass it around.

You are not allowed to exploit another employee are you? This is not exploitation. Just really bad judgment on the part of several people.

I would go to the management before they came to me and tell your side of the story. Which is what, precisely? That he/she posted nude photos of him/herself on the internet (or someone else did) and now they're being passed around at work?
