One point you may want to keep in mind - a phone record shows that a call was placed from number A to number B and that the call lasted x minutes. It does not prove who you spoke with or what was said during that conversation. Don't get too hung up on phone records "proving" anything except that a call was placed.

My hearing is set for this Monday. As instructed I faxed pertinent phone bills. I did retract (block out) all irrelevant calls, I hope this was alright. And get this, I am to appear by phone! The paper work said, "appear by phone" on one side and on the other side it says, "you must arrive on time or may not be heard." I called and was assured it was a telephone appearance. I also received the case file making me ware of what my employer stated. It really doesn't make a difference, I am just going to state my side of the events with evidence contact was made, and my shock to being terminated.

In the paper work they claimed I was repeatedly warned, this is completely not true, would they be obligated to produce documented warnings with my signature?

I was told it usually doesn't take longer than an hour. I am due to leave on a cruise with my children that day and will be driven to the port at the time of the call. I really did not want to postpone. It's my understanding it takes about three weeks for them to come back with a decision.

I have stopped the compulsion and feel calm and relaxed, thank you all again!

The special instructions state:
"To claimant, produce proof of compelling reason for your absence from 10/7-10/10 and for not reporting these absences. Provide phone records or other proof if you say you reported the absences. *must provide before hearing."

I just hope the records mean something, as they are all that I have.

I came home from vacation to find the Judge issued a determination the day after my hearing. She overruled the previous determination and granted me benefits!!

You were 100% correct with your advice and I took every suggestion. It was nice knowing what to expect and she included my email and phone records as evidence. The Judge also stated it comes down to who is more believable.

NYS Unemployment

I am collecting unemployment for the past 5 months. I only was paid for 3 because I did not have access certify online to certify the benefits. I contacted the NYS unemployment and told them the specific dates that I was not paid for, they replied to via letter that my claim for the 2 months was denied based that I did not certify the benefits online based on that I did not have access to a computer. Please help me how I can fight this as I have 30 days to appeal. Thank you

And no point in appealing. Go forth and certify now for the weeks as they pass, and you'll get paid for them. If you don't certify, you won't get paid. There IS no appeal. Just reopen your claim and go on from here. You haven't lost the weeks, you just didn't get them during that two month period. By your own bad choices, it would seem. Now, get yourself a computer and file and get paid for weeks like you're supposed to.
