What is the name of your state? TN

Our divorce hearing was on June 10th. I was awarded custody of our four daughters. Ex husband is to pay $1000 a month child support on the first and fifteenth. I moved out of the house on the 18th and assumed child support would start immediately. On the 1st of July he gave me a check for $350 which was supposed to be support from the day I moved out. (should have been $399 by my calculations) I also thought he owed me the July 1st payment of $500. He says his atty. tells him that support is paid after the fact, not in advance. My atty. says the opposite. Seems to me that support is for the future needs of children not to reimburse. Who's right here? Where can I find something in writing to show my ex husband if I am correct.

And please, Mr. Liable, no cracks about the fact that I'm writing from TN. I was raised in FL by a very northern mother. Not a day goes by that I don't look around and ask myself how the heck I ended up here.

MY RESPONSE: Your attorney is correct - - However, your Marital Settlement Agreement (MSA) should definately had said something to the effect that " . . . child support shall and will begin on (date) and shall and will continue until such time as each child shall be emancipated . . . "

Child support is NOT "reimbursement" when initially ordered. The only time it becomes "reimbursement" is when "arrearages" are to be paid. Since you're already having problems with the "Louse", you can expect that when State law allows child support to be terminated at a certain age, do you believe he's going to pay his last payment AFTER that age of your children occurs? No. If you make a fuss about it, he'll use the argument that when the first payment was to be paid, you should have dealt with it at that time. Nice guy. He'll have you "going and coming." Have your attorney file a "Request for Clarification of Judgment" with the court. Hopefully, the judge will "amend" the Order to include a "start date."

The ex is REALLY having a problem with being told what to do in stead of doing what he darn well pleases. Guess I'll keep up the fight.

I share your feelings on hillbillies, by the way. My genes, however are all in the proper pool.
