What is the name of your state?Ohio

I am 22, my girlfriend is 17. We recently found out that she is pregnant. Here mom has an abusive past and has told her she would kick her out if she ever found out she was pregnant. I actully have a couple of questions on this matter.

1)According to ohio law can she leave her moms resident in the event that the baby's life would be in danger such as her mom hitting her while she is pregnant?

2)In ohio, if she was able to support herself would she be able to move out on her own at 17?

3)under ohio law, 16 is the age of sexual consent, so would her mom be able to bring any charges against me?

Please help. I am seeking legal advise on this matter and every little bit will help. If you have any information please post it here or email me @ jw4472@yahoo.com Thanks

My response:

Is there a trailer in this story? If so, is that a single-wide or a double-wide?

No there is no trailer in this story, i don't even see how you would get a trailer from it.

My response:

It's quite evident. In fact, it's very logical.

You see, only trailer trash mothers would even think of hitting their trailer trash, pregnant, 17 year old daughters.

Now, doesn't that make perfect sense?

Ignore him, everytime something like this comes up, he calls everyone and their brother trailer trash.

If there is abuse going on your girlfriend needs to call the police or talk with a school consouler, to get in touch with CPS. Otherwise, no she cannot leave home at 17, if she did, her mom could call her in as a runaway. The police would find her, and arrest the person or persons who were harboring her as a run away. Until she is 18 mom says what goes.

Where is her father in this, does he know about the abuse?

The only was she could leave home, would be if she were emancipated, by seeing as how she got pregnant I doubt the court will allow her, they would see it as her not being responsible.

As far as you getting into trouble, yes you very well can get into trouble. It's against the law to have sex with a minor, and since there is not four years but five years between you, by sleeping with her, you comminted statutory rape, it doesn't really matter if she concented to it or not. So in other words yes, if her mom wanted to she can press charges against you.

Ohio
Age of Sexual Consent: 16
Sexual assault for a person age 18 to engage in sexual conduct with a minor if the actor knows that the minor is between ages 13 and 16

Thank you for your reply. Her mother and father are getting a divorce because he used to beat her and her mother. He does know about the abuse from her mother but he is twice as bad.

Then the best thing to do would be to tell someone that can help her, you can't do this on your own. She needs to call the police or someone at school, a teacher or consouler. If there is abuse going on they will be able to get her out of the home, and either put her in foster care, unless of course there is another relative that is notified and she can be placed with them, Aunt, Unlce, Grandparent.

Although, this means the pregnancy will have to come out about you being the father, which means you could have a chance in getting into trouble, but the question you have to ask yourself. What is more important the life of your girlfriend and child, or yourself?

Good luck.

And what options do you see that he has, remember this also concerns a pregnant 17 year old girl, who comes from an abusive home. Her father abused her and her mother and now her mother is abusing her.

The girl needs to be removed from her own, for her protection, aswell as the child she is carrying. And then her mother needs to get help right away for her problem.

thank you wolflmg. we have taken upon ourselves to involve child services. They said that no criminal action will be taken against me, and my girlfriend will probally be put in foster care until 18.

But, now i have a new question. what will be my rights as far as seeing her and the baby until she turns 18?

Well since your not married, I believe that after the child is born, a DNA test must be done to prove that your are the father. And you would go from there, otherwise I believe that once the child is born you and your girlfriend put you down as being the father on the birth certificate, that gives you your rights as the father, but the court system stil might what a test to be done.

I would defently talk to chid services see what they have to say and if possible take with the foster family that will be taking her in.

I hope everything works out for the best, and I'm glad you did the right thing by getting child services involved.
