Sure, every settlement contract will have a percentage for the parties involved. The problem with your post is that a doctor does not usually sign a settlement contract since it's between a lawyer and a client. Doctors are only entitled to their bills and that's it. Anybody that would give them 33% of a settlement needs to get another lawyer!

guess i should rephrase it. Yes you sign a contract only with a lawyer. A lawyer usually will pay the doctor bills from what he made. Hence were i got 33%. I should not have mentioned the doctor at all in this discussion but i did.

i signed multiple settlment contracts

November 03 rear-ended.. Car totalled. That part is taken care of.
I went to REAL doctors, got REAL physical therapy, no acupuncture or Chiropractors or massage therapists. MRI as well.

Bills, with Rx and lost wages total $10,000.

Yes I have an attorney, but he seems to be allergic to the phone. I am none to pleased with him. :(

This really is dragging on and has thrown my finances into a tailspin. I am just trying to recoup some losses, not rape the insurance company..

What might I see?

YAG , just being funny. Look I am a woman... Accident was their fault, their insurance.
I am not claiming any future losses... I would like to claim hairdressing appnts, because I did get a streak of white in my hair... But ...
But... If these are the numbers, and you are a retired insurance adjuster...
Or an attorney who had someone with these numbers and facts... come into your office and you were dealing with an insurance co. what would you offer or counter offer?
Or someone a else (NOT YLEN) that might know something about what they do to calculate the ol' pain and suffering... Could I get a guestimate. :o

Knowing the (alleged) injury and (alleged) permanence might help with a guesstimate. Right now, I'd say the 0 to 100k range you were already told would probably cover it.

I thought the my approach was okay.
I thought giving the whole story was GOOD.

I am in financial hell here. I am in debt from lovely people that I owe and it is causing me hell and yet I keep my sense of humor. If it drives me over the edge maybe I will ask my lawyer if he answers the phone to add it on. BUT I WANT IT FINISHED> Can I have something from somebody????????

health insurance... but It just doesn't cover it all. They want more. I give them the "at fault" guys
(see I don't even know the lingo) Car Insurance companies name and the "lawyer's" name. and Pray my credit doesn't get much worse. How much do I have to wait. I don't even here what is going on.


Therapy for the Ptsd is the only thing ongoing.. But I will pay the co-pays because right about now its just the angst from Just not as well not knowing who elsecan just plow into you and throw apart your life that makes you nutso and hard to get through.
I don't want anything more than someone letting me know I can feel I have some control of my world again... not the traffic , not the other drivers. but that the people I owe and the things I have neglected can get some focus and I can feel I have SOME CONTROL.

Back to the OP's question.... you never know what a jury will do. When evaluating these claims, I would guess the insurance company will offer around $15,000 to $20,000 to settle.

Were I evaluating the case, I'd value the case between $20,000 and $40,000.

1. What city did this accident happen in?
2. What are your specific injuries?
3. How long have you been treating?
4. When did you first seek tratment? I.E. Did you leave in an ambulance?
5. What is your medical history? Any previous injuries or surgery?
6. How much pain are you in now?

There are a lot more to ask but answer these and I'll tell you what I would offer. To be honest w/ you I don't know how accurate I would be. If you had whiplash and $500 bucks in meds I could tell you, but w/ 10k I would really have to review the meds (or have them reviewed) and look at your medical history,look at damage on the cars, among other things. Also meeting face to face is important also. Gives you a chance to feel them out so to speak.

Car was not worth much. it was old and paid for. It was a 93 VW Fox and only had 78,000 on it because I worked at home. so it had some value. and it would have run a long time. But blue book would not have valued it so. As I said that part was paid for. I needed money to buy another used car, as I do not work at home any more.

Meds were for pain. and anti-depressants ( I know blue pills, white pills, red pills bring it on) but it was dang hard to drive after you are hum da hum sitting at an on ramp waiting for the meter to tell you 2 cars per light and BAMMO! you are on the dashboard.)
No pictures.. no bruising.. no ambulance... Went to work.. after co-worker picked me up.. broke down at work... co-worker brought me home.. friend brought me to docter next day when I couldn't move. Sorta like whiplash but in back.
Did PT... lost some work.. took some medicine ..got ... did some excercises... got behind wheel... did some head shrinking... borrowed some money...yadda yadda yadda...
Please ask me anything else. I am all ears.( Unlike my lawyer.) I am really a self sufficient person and this has made me feel 15 again. If I can pay back my friends, get some money back in the bank and stop feeling like the victim.. maybe I won't be so silly to post such a silly thread like this :o

Pretty Conservative area. La Costa police report, Not CHP. Mixed area of people though. I live there and am poor as peanuts, but live behind a house where they are rich as midas.
The man who hit me does not have a lot of money, but pretty big insurance Co.. not one of the dinky ones (should I mention which co it is) I am sorry I am not sure of the caps on it, I am sure my case won't go that high.

My lawyer is not known by reputation to want to go to court. settle settle settle...He was given to me by friend, I am being given a discount from the usual rate of contingency, might be why I am not being given such hands on attention, and why I am not being too squeaky of a wheel. :o
My medical records/billings/copay receipts and letter from therapist are what the Insurance company are going to go on.

Gosh, there really is a lot that goes into this, Location location location Huh?

You have 10K in meds. Soft tissue injury. Conservative area. Doesn't appear to be lingering bodily injury. Have treated f/ 6 mo's.

I would put your settlment in the range of 15-30k based on the info. I have here. Please keep in mind that this is only an educated guess as to what the final settlement will be. I'm also an adjustor in KY and OH so not familiar w/ CA. Payments may be higher out there. My area is a conservative area so punitive damages are lower here. (Cincinnati & N KY area)

Maybe this helps, maybe it won't. Anyway that's my shot at it.
