What is a one or two party state? I have read this in some posts? I live in S.c. How would I find out? What does it mean ? I understand it regards taping, can you clear it up for me . Thank you.

What you are referring to is taping conversations...say on the telephone. If you are in a one party state (which SC is) that means that only 1 person needs to know they are being taped....and that 1 person could be the one taping. So, in other words; you could tape your conversation with someone and use it against them

If you live in a 2 party state, then you have to inform the other person of the taping...both participants need to be aware they are being recorded in order to use it as evidence. And if you live in a 2 party state, and don't obey this law; you could face charges.

Lets clarify this..

It is 'One Party to the conversation'. Not 1 person. This means you have to be party to the conversation as opposed to just knowing about the taping. This is a very important difference as it means that a CP can not tape the conversation between the child and the NCP. The CP knows about the taping, but is not party to the conversation. So, it would be illegal. The moment the CP takes the phone and becomes a party, then she can tape legally.

Also, it is not 'Two Party' it is 'All Parties'. Therefore in All Party states, everyone taking part in the conversation needs to be aware, not just 2 people.

Thanks LB for clarifying....I responded with the impression that only 2 people were on the phone and no one was thinking of taping "others".(not their own conversation) I guess I didn't generalize that this sort of thing does and could happen.
