The case hasn't been tossed, round 1, the high school tuition and temporary support was lost. There will be another hearing in April about the rest.

There will be another hearing on college support. The rest did get tossed.

She might have a good case for college support. She will be penalized for her parents income level in the financial aid hunt - if they provide the financial documents she needs to apply. She will be penalized if they don't. In other situations and cases parents have been ordered to pay support during college for many years. For example, a parent paying child support is stuck paying throughout college - whether a relationship with the child exists or not. If it is a duty for a formal non-custodial parent to pay support during college, why wouldn't be for these parents to pay support during college?

This is true - but generally speaking college support needs to be ordered before the child ages out.

In this case however all she is suing for is a pre-established college fund...and we do not know who all may have contributed to that fund.
