Our second mortgage is a fixed rate at 9.99% for 25 years with monthly payments of 390.34. In April while online to make my payment I noticed $872 posted to my account (not my money) so I called to tell them they made a mistake. After being told my husband may have paid it, it was by mail(but no check number), maybe I forgot, the customer service person told me to put in writing. So, after looking over a detailed printout I discover that they have posted two payments tothe same month (more than once), posting payments forward as much as a couple of months (but all to interest). After writing my qualified written request and disputing their accounting, I got a line of bull. Since April their standard response is "After Initial Review we need to investigate further, we anticipate 30 days". This has been since May, I quit paying my payments (which I should not have done), and am now in foreclosure. 2 months after I stopped making payments we received a notice of default, during this time we were not able to access our online account, they would not accept our payments, now won't return phone calls. I've seen a CPA and 3 Lawyers, they all say I should pay the exorbinant fees they are demanding just to stop the proceedings. I shouldn't have to pay, they say I'm right. Any direction?
 


Pay it up so you don't lose your home. Then sue them over the discrepancy. Please note that if extra payments were made when they were not due then the extra amount will go towards the priniple and not the next month's bill.
