Is there at any time that an employer is NOT required to pay overtime pay for hours worked over 40?

I've been told that if a business is considered seasonal (like a movie theater) that they aren't required to.

Any ideas?

Since when is a movie theater considered seasonal? The movie theater in my town runs 52 weeks a year.

However, the basic premise is correct. There is such an exemption.

An employee who qualifies as exempt (which is entirely dependent on their job duties) does not have to receive overtime no matter how many hours per week they work.

A non-exempt employee who works for any business in any industry that is EITHER engaged in interstate commerce OR has an annual sales total of $500,000 or more, MUST be paid overtime for any hours they work over 40 in a week (and in some states, though not yours, for any hours they work over 8 in a day). However, the link below will explain an exemption for seasonal employers and will define which employers may fall into the exemption.
